HURBURT, Inc.
A legal publisher and pioneer of new argument guides for law practice, our first set of offerings—Trademark Argument Guides for Likelihood of Confusion and Mere Descriptiveness—is based on the research of more than 25,000 cases. Tested against statistical measures, our guides take decades off the time generally needed for attorneys to learn these winning arguments and strategies.
Founded in 2019, the idea for the guides dates back to 2013 when founder Herbert T. Patty, Esq. was working as a patent attorney.
As more and more clients began requesting trademark services, Mr. Patty became interested in discovering best practices, notably, the most unique arguments and strategies employed during ex parte prosecution proceedings at the USPTO. By answering the questions “Are legal arguments discrete elements that can be identified in various trademark cases?” “Which legal arguments have been used singularly, or in combination, to successfully overcome specific trademark refusals?” “Is it possible to perform a statistical analysis for legal arguments present in a large corpus of law briefs?” a new category of legal books was born.

Herbert T. Patty
Founder
Herbert Patty, known to family and friends as "Teddy," is a Registered Patent Attorney licensed to practice law in California, the D.C. Court of Appeals, and the United States Patent and Trademark Office (USPTO), Herbert T. Patty, Esq, founded HURBURT, Inc. to cover a gap in the legal reference book market.
Mr. Patty graduated from Georgia Tech with a degree in mechanical engineering and from the Santa Clara University School of Law with a juris doctor degree and a High Tech Law Certificate.
Leslie Burton
Editor
Leslie Burton is a legal writing coach, trainer, and editor. She is also a former law professor at Charles University in Prague, Czech Republic; Friederich Alexander University in Erlangen, Germany; University of Ljubljana in Ljubljana, Slovenia; Suor Orsola Benincasa University in Naples, Italy; and Bahcesehir University in Istanbul, Turkey. Leslie graduated cum laude from Santa Clara University Law School and is a two-time Fulbright U.S. Scholar awardee.
Walt Flom
Statistician
Walt Flom is an applied statistician with over 30 years of experience, including tenures at Intel and AMD. His statistical areas of interest include data analysis, graphical analysis, design of experiments, process control and reliability. He holds an MS in applied statistics from UW-Madison and a BS in math from UC Davis. Walt lives in Santa Rosa, California with his wife and two dogs. He enjoys cycling with friends in the scenic hills and vineyards of Sonoma County.
